Federal Rule of Civil Procedure 16.1: Essentials for Antitrust MDL Litigators

Federal Rule of Civil Procedure 16.1 goes into effect on December 1, 2025. The Rule is the first to focus on MDLs and strongly encourages judges to schedule an initial case management conference early in a case—likely before class leadership is appointed—and require parties to file a broad case management statement. However, critiques regarding mass tort MDLs, not antitrust MDLs, were a significant driver to create and shape the rule. Attendees will learn the mechanics of Rule 16.1, how it interacts with Rule 23, and hear perspectives on how to approach courts as they engage with the Rule for the first time.
