MSBA champions legal reforms

Every year, the MSBA Assembly adopts a slate of legislative policy priorities identified by our members. Bar Association sections and committees can also take policy positions on their own, by following procedures outlined in our bylaws.  

What do we do? 

  • We advocate at the legislature for a strong justice system and statutory improvements. 
  • We influence the courts or court-related entities by filing petitions for rule or procedure changes, filing responsive comments, and submitting amicus briefs.  
  • We partner with the American Bar Association and other bar associations to weigh in on matters of national and local importance. 

2025 MSBA policy accomplishments 

MSBA has a storied history of successful policy action. Some recent highlights: 

  • Court rule changes – In 2025, the MSBA submitted rule change petitions to the Minnesota Supreme Court on three issues: expanding digital court records access, enhancing protections for people seeking gender-affirming name change or birth record corrections, and improving the emeritus attorney rule to allow more retired attorneys to do pro bono work. MSBA committees filed comments in response to four additional Supreme Court petitions.   

  • Public education – The MSBA Access to Justice Committee released a new report on the economic value of civil legal aid services in Minnesota. Analysts found that for every $1 invested in civil legal aid, Minnesota receives $4.32 in immediate and long-term financial benefits—a 432% return on investment. In total, civil legal aid activities had a net economic impact of more than $239 million statewide last year.   

  • Amicus litigation – The MSBA Tax Law Section filed an amicus brief in a case involving tax crime interpretations. 

  • Legislative reform – In 2025, the MSBA and other stakeholders collectively defeated a proposal to tax consumer legal services. The proposal would have made legal services for individuals – but not companies – more expensive. In addition, 6 MSBA legislative priority bills were signed into law in 2025.
