Voting Rights in 2026: Litigation, State Constitutional Protections, and Election-Day Issues
This presentation will focus on recent developments in voting rights law following the Supreme Court’s decision in Louisiana v. Callais, including the growing role of state statutory and constitutional claims, with particular attention to Minnesota law and the role of state courts. It will also cover practical election administration issues likely to arise during the 2026 election cycle, such as voter eligibility challenges, voter intimidation, absentee ballot disputes, and related topics.

The Role of the Rule of Law CLE Series: Lawyering in a Constantly Evolving Legal Landscape
The ABA’s World Justice Project has proposed a working definition of the rule of law that includes four principles:
- A system of self-government in which all persons, including the government, are accountable under the law
- A system based on fair, publicized, broadly understood and stable laws
- A fair, robust, and accessible legal process in which rights and responsibilities based in law are evenly enforced
- Diverse, competent, and independent lawyers and judges
