Summary

Part I | Understanding and Managing Risks of Artificial Intelligence in Design 

Attendees will learn about how Artificial Intelligence (A.I.) is used in design today and its possibilities for the future; identify related risks for construction and design; and provide insights and best practices for construction and design companies to manage those risks.   


Part II | Ethical issues for lawyers guiding clients’ use of generative AI tools in the construction industry (1.0 Ethics CLE credit)  

“Good, fast, cheap” – The adage used to be that you can get two of the three, but not all three. Does the availability of generative AI change what is possible for architects, engineers, and contractors working in the construction industry? Can those with access to AI deliver services that are all three—good, fast, and cheap? If so, what will that do to competition in the industry? Will the cost of sophisticated AI result in a distortion of the market by reducing who can compete for larger projects? How do you advise a client that wants to use AI to save time but is not ready to pass that savings on to their clients? How do you advise clients using AI about adequate disclosures related to use and limitations of generative AI on their projects? Does a client have a duty to disclose use of AI to subcontractors or vendors on projects? Does a client’s use of AI to anticipate risk and avoid unexpected costs or delays place the client at risk for increased liability if those predictive measures prove unreliable? These are just a few of the implications of AI on a businesses’ ethical obligations. This presentation will explore not only a client’s ethical issues associated with AI in the construction context, but also the lawyer’s ethical duties when advising clients in that space.
