Roughly half of marriages end in divorce and, unfortunately, divorce can lead to a bankruptcy filing by one or both spouses. Sometimes the cost of setting up two new households can tip debtors into insolvency. Other times, a debtor may file for bankruptcy seeking relief from divorce-related legal fees or financial obligations to a former spouse. This CLE will focus on the intersection of bankruptcy and divorce, with specific emphasis on the potential impact of a bankruptcy filing upon a debtor’s prepetition obligation to pay child support, alimony, attorneys’ fee awards, equalizer payments, and other marital property settlements.
