Summary

The Bankruptcy Section will hold a brief business meeting beginning at 12:00 pm, followed by the CLE presentation.

When representing SBA lenders in bankruptcy, it is imperative to understand that requirements upon lenders in order to maintain a lender’s SBA guaranty. Failure of a lender to adhere to SBA requirements could result in a repair or denial of a lender’s guaranty. This presentation will address the intersection between SBA loans and bankruptcy, including when a lender needs an SBA approved Litigation Plan so that your legal fees are reimbursed by SBA and the process to obtain SBA approval for actions your client wants to take throughout the bankruptcy process.
