The New FinCEN Real Estate Reporting Rule, Effective March 1, 2026

The Department of the Treasury has long recognized that the illicit use of residential real estate threatens U.S. economic and national security and can disadvantage those that seek to compete fairly in the U.S. real estate market. This reporting requirement is designed to increase transparency in the U.S. residential real estate sector and to combat and deter money laundering. The Financial Crimes Enforcement Network (FinCEN) has implemented a reporting rule for specified real property transactions occurring on or after March 1, 2026.  Learn about qualifying transactions, the significant amount of party information that must be collected and reported, and how this rule will affect real property conveyance transactions going forward.
