In Tyler v. Hennepin County (2023), the U.S. Supreme Court ruled that Minnesota’s practice of retaining surplus proceeds from tax-forfeited property sales violated the Fifth Amendment’s Takings Clause. This session will review Minnesota’s pre-Tyler law, the case’s progression through the courts, the Supreme Court’s ruling, subsequent legislative changes, and ongoing legal challenges.
